Terms of Service

These terms are a working draft. They have not been reviewed by a lawyer and are not final. They are here so the acceptance machinery can be built and tested against real text rather than placeholder filler. Replace them by publishing version 2 before any real customer is asked to agree to them.

1. Who these terms are between

These terms are between Insurvas ("we", "us") and the business that subscribes to the service ("you"). The person who accepts them confirms they are authorised to do so on behalf of that business.

2. What the service is

Insurvas is software for insurance agencies to manage their book of business. Which features you can use depends on the plan you subscribe to. We may add, change or remove features; if we remove something you rely on, we will tell you before we do.

3. Your account

You are responsible for what happens under your account, including anything your users do. Keep credentials secret and tell us promptly if you think an account has been compromised. Do not share one login between people.

4. Your data

Your data stays yours. We process it to run the service for you, as described in the Privacy Policy. We do not sell it. You can export it, and if you close your account we will delete it after a reasonable retention period.

5. Fees and billing

You pay the fees for your plan in advance, for the billing period you chose. Payments are handled by our payment provider, who acts as merchant of record. Fees are non-refundable except where we say otherwise in writing or where the law requires it. If a payment fails, we may suspend access until it is settled.

6. Trials

A trial lasts for the period stated when you sign up. At the end of it, unless you cancel first, your card is charged for the plan you selected and the subscription continues.

7. Acceptable use

Do not use the service to break the law, to send unsolicited bulk messages, to store data you have no right to hold, or to attempt to gain access to parts of the system that are not yours. We may suspend an account that does.

8. Availability

We aim to keep the service running but do not promise it will never be unavailable. We will give notice of planned maintenance where we reasonably can.

9. Ending the agreement

You may cancel at any time, effective at the end of the period you have paid for. We may end the agreement if you materially breach these terms and do not fix it after being asked.

10. Liability

Nothing here limits liability that cannot lawfully be limited. Subject to that, neither party is liable for indirect or consequential loss, and our total liability is limited to the fees you paid in the twelve months before the claim.

11. Changes to these terms

We may publish a new version of these terms. If a change is material, we will ask you to accept the new version before you continue using the service, and we will tell you what changed. Previous versions remain available.

12. Governing law

To be determined by counsel before these terms are finalised.
